CALL TO CAUCUS TO NOMINATE A DEMOCRATIC CANDIDATE FOR VIRGINIA 77TH District House of Delegates Seat

The Virginia 77th District House of Delegates Nominating Committee will hold an unassembled caucus on Tuesday, August 16th, 2016 between 3pm – 7Pm in the following location:

For the purpose of nominating a Democratic candidate for the Virginia House of Delegates 77th District.

Candidate Filing: Each person seeking to become the Democratic nominee for the office of the 77th District House of Delegates shall file a Declaration of Candidacy form with the 77th District House of Delegates Committee along with a $2,500 non-refundable fee by certified or cashier’s check (cash or money order not accepted) made payable to the Chesapeake Democratic Committee beginning at 12 noon on Monday August 8th, and ending 5 pm Wednesday, August 10th. Filings shall be made either in person or by mail with the Chair of the Nominating Committee’s designee, Glenn Francis. Only those candidates who have timely and properly filed their Declarations of Candidacy form and paid the filing fee may have their names placed in nomination. The order of the Candidates’ names on the ballot shall be determined by the order they are received. Should two or more filings be received at the same time, a random drawing will take place to determine the order of the names on the ballot. The Declaration of Candidacy form shall be available jointly on the websites of the Chesapeake Democratic Committee, (www.Chesdems.com), and the Suffolk Democratic Committee (www.suffolkian.com).

Qualification of Candidates:
1. They are a Democrat and not a member of any other political party.
2. Does not intend to support any candidate who is opposed to the Democratic nominee
in the 77th District House of Delegates Special Election.
3. Has not participated in and will not participate in the nominating process of any other
party for the 77th District House of Delegates Special Election.
4. Does not intend to file as an independent candidate for the House of Delegates 77th
District Special Election.
5. Is registered to vote in the 7fh District of the House of Delegates.

This call to caucus shall be published on the democratic committees’ websites (listed above) and on the Democratic Party of Virginia (DPVA) website, (www.vademocrats.org). A press release shall be provided to all relevant newspapers of general circulation in the 7fh District House of Delegates. The committees will be encouraged to disseminate this information to all interested parties, as they are able, in accordance with the Party Plan of the DPVA. In addition, reasonable actions shall be taken to promote participation in the caucus in accordance with the Affirmative Action provisions of the Party Plan of the DPVA.

Participation: Every Democrat who is a registered voter in the nth District of the House of Delegates is urged to attend and participate. Each participant must sign a written declaration that he or she:
1. Is a Democrat and not a member of any other political party.
2. Does not intend to support any candidate who is opposed to the Democratic nominee
in the 77th District House of Delegates Special Election.
3. Has not participated in and will not participate in the nominating process of any other
party for the 7~ District House of Delegates Special Election.
4. Is registered to vote in the 77th District of the House of Delegates.

Determination of Nominee: If only one person files properly to be a candidate for the Democratic nomination for the 77th District of the House of Delegates by the filing deadline, the Nominating Committee may cancel the caucus and declare that person the nominee and the filing fee will be returned. If no person files properly to be a candidate for the Democratic nomination for the 77th House District by the filing deadline, the Nominating Committee may cancel the caucus.

At any time before 5 PM ET, Friday, August 12, 2016, the Chair of the 77th District nominating committee may rule ineligible for nomination any candidate who has been found to have made any false or misleading statements on the Declaration of Candidacy, or who failed to pay the filing fee. If there is no filed candidate, or if the properly nominated candidate withdraws or dies, the Chair of the Nominating Committee may, before 8PM August 16, 2016, convene the Nominating Committee to consider the nomination of a qualified candidate who may become the Democratic nominee upon first filing with the Nominating Committee, a Declaration of Candidacy form and paying the filing fee for such office. Waivers: The Nominating Committee shall seek appropriate waivers from the DPVA regarding expediting the time frames required by the Party Plan, if necessary.

Should the caucus take place, it will be the responsibility of the Chesapeake Democratic Committee to pay any and all expenses for the conducting of the caucus upon request of the nominating committee. Expenses will be paid using the non-refundable filing fees received from the candidates duly filed.
